Terms of Service

1. Acceptance of Terms

By accessing and using the CLARITH Web Studios website and services, you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using CLARITH's services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Description of Service

CLARITH Web Studios provides high-revenue commercial contractors with automated revenue infrastructure systems, including but not limited to:

  • The Lead Shield - Automated missed-call text back system
  • The Reputation Engine - Automated review collection via SMS
  • Speed-to-Lead Bridge - Instant lead-to-call bridge for web forms
  • Related consulting and implementation services

3. Eligibility & Qualification

Our services are specifically designed for commercial contractors generating $500,000 or more in annual revenue. We reserve the right to qualify partnerships based on revenue criteria and business fit. All potential clients are subject to our onboarding approval process.

4. Payment Terms

Payment terms are as follows:

  • Services are billed according to the agreed-upon pricing in your service agreement
  • Payment is due within 30 days of invoice date unless otherwise specified
  • Late payments may incur a fee of 1.5% per month
  • Services may be suspended for non-payment

5. SMS Communications & A2P Compliance

Application-to-Person (A2P) Messaging Disclosure:

  • Consent Requirement: By providing your mobile phone number and checking the SMS consent box(es), you explicitly consent to receive automated text messages from CLARITH Web Studios.
  • Message Types: We send two types of SMS communications:
    • Service Notifications: Messages related to your inquiry, appointment reminders, and system status updates. These are sent based on your request for information or services.
    • Marketing Messages: Promotional messages about our services, special offers, and company news. These are only sent if you explicitly opt-in.
  • Opt-Out: You may opt-out of SMS communications at any time by replying "STOP" to any message. Upon receipt of your opt-out request, we will remove your phone number from our SMS marketing list within 10 business days.
  • Message Frequency: Message frequency varies based on your engagement and preferences. Standard message and data rates may apply.
  • No Sharing: We do not share your phone number with third parties for their marketing purposes.
  • Carrier Liability: Message delivery is subject to effective transmission by your wireless service provider.

This SMS disclosure complies with CTIA (Cellular Telecommunications and Internet Association) guidelines and the Telephone Consumer Protection Act (TCPA).

6. Intellectual Property

All content, designs, logos, and materials on this website are the exclusive property of CLARITH Web Studios and are protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

7. Limitation of Liability

CLARITH Web Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. Our total liability shall not exceed the amount paid by you for the services in question.

8. Service Availability

We strive to maintain 99.9% uptime for our automation systems. However, we do not guarantee uninterrupted service. Scheduled maintenance may occur, and we will provide advance notice when possible.

9. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, any outstanding fees remain due. All provisions that by their nature should survive termination shall survive.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these terms at any time. Your continued use of our website and services after any changes indicates your acceptance of the new terms.
